Terms of Service

These Terms of Service ("Terms") govern your use of the official online store and related web and mobile services (the "Service") operated by K-Wave Collective Inc. (the "Company") and the purchase of tour and concert official merchandise (the "Products"). Please read these Terms before placing an order. By using the Service or checking out, you agree to be bound by these Terms.

1. Purpose

These Terms set forth the terms and conditions for the electronic commerce services, orders, and incidental features (such as notices and account tools) that the Company provides, and the rights, obligations, and responsibilities of the Company and you.

2. Definitions

The "Service" means the official K-Wave Collective website, store, community/notices, account, and any other online channels the Company may operate. "User" means any person who accesses the Service, places orders, or views content, and "Member" means a user who has completed registration and may sign in with an email. Guest checkout may be allowed for some orders, in which case the order, shipping, and return provisions of these Terms still apply. "Product" includes limited tour MD such as light sticks, albums, apparel, and photocard sets, including pre-orders, random packs, and venue-only items, each as further described on the product page and in notices.

3. Effect and changes

These Terms are effective when posted on the Service. The Company may revise them in line with applicable laws (including consumer and e-commerce rules). We will post material changes in notices or in a way that a reasonable person would see them before they apply. If you keep using the Service (including free browsing or future purchases) after changes are posted, you accept the changes to the extent permitted by law, except where a separate and explicit consent is required for certain processing.

4. What we provide

The Service includes presenting Products for sale, order and payment, domestic and international shipping, promotional events, posting release and restock information, and customer support. Some items may be sold only at a venue, require a ticket, or only for pick-up, as listed on the product page or in official notices, which in case of conflict take precedence for that product.

5. Your responsibilities

You must provide accurate shipping, contact, and payment information. You must not use the Service to infringe third parties' intellectual property, commit fraud, abuse coupons or promos, overload systems, or engage in large-scale or automated purchasing intended to circumvent stock limits, resale, or the Company's published policies. The Company may cancel orders, suspend accounts, and pursue legal actions where appropriate.

6. Orders, contract formation, and payment

An order is an offer. The contract is formed when the Company (or a payment service provider) authorizes the charge and the Company accepts the order, subject to inventory and fraud checks. Prices, fees, and quantity limits (per person, first-come, etc.) are shown on the product page or in notices. KRW, major cards, and other methods may be available depending on your region; bank and card fees and FX rates are set by your bank or the PSP.

7. Shipping, international, and customs

Domestic shipping typically ships within a few business days; international orders can take much longer. Import duties, taxes, and broker fees, where applicable, are usually your responsibility, under the law of the destination country. The Company is not liable for delay due to customs, wrong address, failed delivery, force majeure, or events outside its reasonable control, but we will work with carriers and you in good faith to resolve issues as described in notices and CS policy.

8. Cancellations, returns, and refunds

Rules depend on the product: sealed, random, and digital-like goods, or time-bound tour items, may be non-returnable after opening or once specified by law and our policy. If the product is not as described or is defective, contact us with photos before opening where we ask, within the return window in your country's consumer rules and our posted policy.

For change-of-mind returns where allowed, items must be unopened and in original condition, usually within 7 days of receipt, and you may pay return shipping unless a notice says otherwise. Refunds are processed to the original payment method where possible, subject to bank timing.

9. IP and official merchandise

Packaging, artwork, logos, and descriptions are protected as trademarks, copyright, and related rights of artists, labels, and the Company. You may not copy, resell, or use them for business without permission. The Company and rights holders may act against counterfeits and unauthorized resale, including monitoring and law enforcement where appropriate.

10. Disclaimers and limit of liability

The Service and Products are provided "as is" to the maximum extent allowed by law. The Company is not responsible for indirect or consequential damages except where the law of your country as a consumer does not allow that exclusion. We are not liable for schedule changes, tour cancellations, or setlist changes, but we will use reasonable efforts to follow our refund and notice practices for pre-orders when those events happen.

11. Privacy

Our collection and use of personal data are described in the Privacy Policy, which is part of your overall understanding of the Service.

12. Governing law and contact

Unless mandatory law in your place of residence gives you more rights, the laws of the Republic of Korea may apply to these Terms, and courts as permitted by law may have jurisdiction.
